At Yismach, we protect the confidentiality and privacy of those registered on our website at www.yismach.com and www.yismach.co.il. We strive to keep your data safe and secure. We have invested in security to protect the safety of your information.

This Privacy Policy outlines what personal information will be collected by Yismach when you use the website and the use and disclosure of your information and personal data.

This Privacy Policy should be read along with the Terms and Conditions of Use and all other operating rules, policies, procedures published on the website which governs your use of the website and service. By registering on the website and accepting this privacy policy and the terms and conditions you agree to the use and disclosure of your personal information in accordance with the terms presented in this policy.


2. WHERE THIS PRIVACY POLICY APPLIES

This Privacy Policy applies to our websites, apps, events and other services operated by Yismach. (hereinafter referred to as “services”).

3. INFORMATION WE COLLECT

Information you give us

When using our services, you choose to give us certain information that can be used to contact or identify you. When you create a profile, you provide us with your name, login credentials, as well as some basic details necessary for the service to work, such as your email, phone number date of birth and marital status. You share with us additional information, such as details on your personality, hashkafa, religious background, education, interests and other details about you, as well as content such as photos and shidduch resumes. We collect this personal information for the purpose of providing the Service, identifying and communicating with you, and improving our services. By choosing to provide this information, you consent to our processing of that information for the purpose of searching for your shidduch.

When you pay an activation fee or when you make a donation (rather than through a platform such as iOS or Android), you provide us or our payment service provider with information, such as your debit or credit card number, banking institution or other financial information. When you participate in surveys, trial studies of matches or name compatibility, you give us your insights into our services, responses to our questions and testimonials.

Information collected when you use our services

Device Information

We collect information about the devices you use to access our website. This may include information such as your computer's Internet Protocol ("IP") address, browser type and browser version.

Usage Information

We collect information about your activity on our services, the pages of our website that you visit, the time and date of your visit, the time spent on those pages and other statistics. For e.g., date and time you logged in, how you interact with shadchanim, shadchanim you interact with, time and date of your exchanges, number of messages you send, and receive. In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase our Service's functionality. These third party service providers have their own privacy policies addressing how they use such information.

Tracking & Cookies Data

We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information.

Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyze our Service.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service.

4. HOW WE USE INFORMATION

The main reason we use your information is to provide and maintain our service and to improve our services. We use your information to communicate with you, help you manage your account, to upload documents, to make changes to your profile at your request, to send you emails about suggestions or emails about our services or changes to our service, to send newsletters, to address technical issues, to connect you to shadchanim, to give shadchanim access to your profile and to activate or deactivate your account.

To improve our services and develop new services, or improve our content we may conduct research and analysis of all users’ behavior to improve our services and content. We may add or delete features based on user behavior. We may develop new features and services at the request of users. We may utilize AI and machine learning to help shadchanim narrow down the viable possibilities based upon suggestion and dating history.

We may use your Personal Data to contact you with newsletters, and other information that may be of interest to you. By accepting this Privacy Policy, you expressly agree to receive this information. If you do not wish to receive these communications you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us.

5. HOW WE SHARE INFORMATION

Since our goal is to help shadchanim find you viable shidduchim, the main sharing of users’ information is with shadchanim when you voluntarily create a profile and disclose information. Shadchanim will share your information when they suggest you to a potential match. If you choose to limit the sharing of your information to specific shadchanim you can make your profile visible to only certain shadchanim,

We also share some users’ information with service providers who assist us in operating the services. We use third parties to help us operate and improve our services. These third parties assist us with various tasks, including data hosting and maintenance, analytics, marketing, payment processing and security operations. All of our service providers must agree to strict confidentiality obligations.

We may transfer your information if we are involved, whether in whole or in part, in a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control.

We may use your information to prevent, detect and fight fraud or other illegal or unauthorized activities and to ensure legal compliance and compliance with Jewish law.

We may disclose your information if reasonably necessary to comply with Jewish or civil law: (i) to comply with a legal process, such as a din torah in a recognized bes din or court order, subpoena or search warrant, other legal requirements; (ii) to assist in the prevention of violation of Jewish law and of crime or (iii) to protect the safety of any person.

In the event of any dispute we may use the information to enforce or exercise our rights as set forth in the terms and conditions. We may also share information: (i) if disclosure would mitigate our liability in an actual or threatened lawsuit; (ii) as necessary to protect our legal rights and legal rights of our users, business partners or other interested parties; (iii) to enforce our agreements with you; and (iv) to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing.

If you are from the European Economic Area (EEA), Yismach’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it. We may process your Personal Data because we need to perform a contract with you, you have given us permission, the processing is in our legitimate interests and it is not overridden by your rights, for payment processing purposes and to comply with the law.

7. CROSS-BORDER DATA TRANSFERS

Your information, including Personal Information, may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. As an example, where the service allows for users to be located in the European Economic Area (“EEA”), their personal information is transferred to countries outside of the EEA. Your information, including Personal Data, may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside Israel and choose to provide information to us, please note that we transfer the data, including Personal Data, to Israel and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Yismach will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

We use standard contract clauses approved by the European Commission or other suitable safeguard to permit data transfers from the EEA to other countries. Standard contractual clauses are commitments between companies transferring personal data, binding them to protect the privacy and security of your data.

8. YOUR DATA PROTECTION RIGHTS UNDER THE GENERAL DATA PROTECTION REGULATION (GDPR)

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. Yismach aims to take reasonable steps to allow you to correct, amend, delete or limit the use of your Personal Data.

If you wish to be informed about what Personal Data we hold about you and if you want it to be removed from our systems, please contact us.

  • The right to access, update or delete the information we have on you. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you.

  • The right to object. You have the right to object to our processing of your Personal Data.
  • The right of restriction. You have the right to request that we restrict the processing of your personal information.

  • The right to withdraw consent. You also have the right to withdraw your consent at any time where Yismach relied on your consent to process your personal information.

9. SERVICE PROVIDERS

We may employ third party companies and individuals to facilitate our Service ("Service Providers"), provide the Service on our behalf, perform Service-related services or assist us in analyzing how our Service is used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

We may use third-party Service Providers to monitor and analyze the use of our Service.


  • Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualise and personalise the ads of its own advertising network.

You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visits activity.

10. PAYMENTS

We may use third-party services for payment processing (e.g. payment processors). We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. You agree that we are not responsible or liable for any of their actions or omissions over which we have no control.

11. YOUR RIGHTS

At any time, you can enter your account and add or delete information. If you experience any difficulty you can contact us at admin@yismach.com.


You can delete your account by request. Certainly if/when you get engaged or married please contact us so that we can delete your account.

We may reject requests for information for certain reasons, including if the request is unlawful or if it may infringe on trade secrets or intellectual property or the privacy of another user. If you wish to receive information relating to another user, such as a copy of any chats you received from shadchanim or any emails from Yismach, the other user, in the case of shadchanim will have to contact our Privacy Officer to provide their written consent before the information is released.


12. HOW WE PROTECT YOUR INFORMATION

No method of transmission over the Internet or method of electronic storage is 100% secure. We strive to protect your information from unauthorized access and disclosure. Although we have taken steps to provide a high level of security, we do not promise, and you should not expect, that your personal information will always remain secure.

While we regularly monitor our systems for possible cyber attacks, investigate any breach of our security and review and update, where necessary, security measures, third parties may unlawfully intercept or access transmissions or private communications, or other members or shadchanim may abuse or misuse your shidduch information, including but not limited to your shidduch resume and picture. Yismach does not assume any liability for the release of personal information by other parties including other registered individuals, shadchanim or third parties. In no event shall Yismach be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of anyone in connection with the use of the site and services offered.

At all times we use our best efforts to protect your information. We may suspend your use of all or part of the services without notice if we suspect or detect any breach of security, or we may suspend or delete use of the site by any shadchanim or other members if we suspect or detect any breach of security. If you believe that your account or information is no longer secure, please notify us immediately.

13. HOW LONG WE RETAIN YOUR INFORMATION

We delete your personal information upon notification of your engagement, unless we must keep it to comply with applicable Jewish law; as evidence of our compliance with applicable Jewish law; there is an outstanding issue, claim or dispute requiring us to keep the relevant information until it is resolved or the information must be kept for our legitimate business interests, such as fraud prevention and enhancing users' safety and security. For example, information may need to be kept to prevent a user who was banned for unsafe behavior or security incidents from opening a new account.

14. CHILDREN'S PRIVACY

Our services are restricted to users who are 18 years of age or older. We do not permit users under the age of 18 on our platform and we do not knowingly collect personal information from anyone under the age of 18. If you suspect that a user is under the age of 18, please use the reporting mechanism available through the service. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

15. CHANGES TO THIS PRIVACY POLICY

This Privacy Policy is effective as of August 8, 2019 and will remain in effect except with respect to any changes in its provisions in the future, which are effective immediately when they are posted on this page.

We reserve the right to update or change our Privacy Policy at any time. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
